We only ever process your personal data within the framework of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (Datenschutzgesetz). Below we provide information on our company and on the nature, scope and purpose of data collection and data use pursuant to the GDPR.

2. Legal basis and purpose of processing

We process all personal data which you provide to us, such as in the context of an enquiry, registration or for concluding a contract. Data is processed for the purpose of handling your enquiry or completing your registration. The legal basis for this processing is therefore your consent to processing which you have provided within the context of your enquiry or registration, and for the fulfilment of a contract. 

The legal basis for processing is therefore: 

  • Pre-contractual measures and fulfilment of contract pursuant to Art. 6 (1b) GDPR 
  • Fulfilment of a legal obligation pursuant to Art. 6 (1c) GDPR
  • Our legitimate interest pursuant to Art. 6 (1f) GDPR in achieving the aforementioned purposes
  • Your consent to the processing of data pursuant to Art. 6 (1a) GDPR

Where you have provided us with personal data, we will only use this data to answer your enquiry, for pre-contractual measures, for preparing, fulfilling and managing contracts, for carrying out the application process, and for technical administration. 

We only forward or transmit personal data to third parties (e.g. insurers, courts, public authorities, banks, tax advisors, public accountants, companies within our group etc.) if this is necessary for the purposes of fulfilment of a contract, or settlement or fulfilment of a legal obligation, if there exist legitimate interests on the part of the controller (in particular an interest in improving and simplifying administration), or if you have given prior consent. 

You have the right to withdraw any consent you have given at any time with effect for the future. To do so, please contact: datenschutz@maresi.at.

Stored personal data will be erased when you withdraw consent to this storage, if your data is no longer required for fulfilment of the purpose for which it was stored, or if the storage of such is or becomes impermissible for other legal reasons. We shall in all such cases observe the statutory retention periods. 

3. Rights of the data subject

Every data subject within the meaning of the GDPR has the right to information regarding what personal data of theirs has been stored, the origin and recipients of such data, the length of time for which such data will be stored and the purpose of data processing. Upon written request at any time, we will provide you with information on what information we have stored concerning you.

If any of your data that we process is incorrect or incomplete, you can demand that the data be corrected or supplemented.

If this is the case, please inform us by writing to datenschutz@maresi.at. We will correct or complete your information immediately. If it is unclear whether data concerning you, which is being processed, is incorrect or incomplete or may be being processed unlawfully, you can demand that processing of such data be restricted until the matter has been fully resolved.

You can also demand that unlawfully processed personal data be erased. However, please note that this applies only to incorrect, incomplete or unlawfully processed data. To do so, please contact us using the address given above.

You also have the right to object to the processing of data concerning you if this data is being processed on the legal basis of our legitimate interest. 

The Austrian Data Protection Authority is responsible for complaints regarding breaches of the right to information, breaches of confidentiality rights, breaches of the right to rectification, or breaches of the right to erasure.

4. Website

If you use our website and/or have given us your consent to use cookies and web analysis tools (e.g. Google Analytics, eTracker, Piwik etc.), please refer to the information below regarding how we process your personal data within the context of our website.  

In principle, it is possible to use our website without providing your personal data. We only collect the information provided by your Internet provider (in particular, your IP address), and information on the time and duration of your visit. We store this data for the duration of your website visit; we only evaluate such data for statistical purposes, and in doing so we observe the anonymity of the individual user.

There is no obligation to actually provide the data we ask you for on our website. However, if you do not provide us with this information, you might not be able to use all the functions of our website.

We process the personal data we collect based on the use of our website for the following purposes: 

  • to make this website available to you and to further improve and develop this website;
  • to be able to prepare statistics on usage;
  • to be able to identify, prevent and investigate attacks against our website;
  • to be able to respond to your enquiry.

5. Applicant management tool/jobs board (Engage tool)

You have the option of applying for a position with us or our group of companies using our applicant management tool/jobs board. We look forward to receiving your application. We only process the personal data you yourself provide when submitting your application.

This includes, in particular: title, first name and surname, street, post code, town/city, country, nationality, date of birth, telephone number, email address, CV, cover letter and other information and documents which you provide us with. 
Where you have given us your consent, your personal data will also be forwarded to other VIVATIS Group companies to allow a more effective and group-wide evaluation of your job application.  

In addition, if your application is rejected, your application documents will be retained as evidence for a period of 18 months after your rejection, provided that you have given us your consent to do so. We expressly point out that any consent you give us can be withdrawn at any time.

6. myVeeta talent pool

Talent Solutions GmbH, company reg. no. 418238g with registered office at Kölblgasse 2, 1030 Vienna, operates an online platform under the “myVeeta” brand for specific services aimed at supporting job-seekers and companies before, during and after the recruitment process (https://www.myveeta.com). Both applicants and companies can register as users with myVeeta for this purpose. In doing so, applicants give their consent to myVeeta, in particular, to pass on their applicant data via myVeeta to specific companies in the talent pool which they have created on myVeeta. VIVATIS Holding AG and some of its affiliated companies (Maresi Austria GmbH and GMS Gourmet GmbH) are registered users of myVeeta and receive data from applicants who register as users on myVeeta from Talent Solutions GmbH.

You have the option of joining the VIVATIS Holding AG, Maresi Austria GmbH or GOURMET Beteiligungs GmbH myVeeta talent pools as an applicant. You can do so by registering as a user on myVeeta and thus making use of the corresponding service offered by Talent Solutions GmbH. By creating a private myVeeta account, you instruct myVeeta to provide us with your data. The data you provide when you register on myVeeta, in particular your title, first name and surname, street, post code, town/city, country, nationality, date of birth, telephone number, email address, CV, career expectations and other information and documents which you provide, will be used for the purposes below only. In addition to the purposes of data processing already mentioned under Section 2, we also use your data to find the right positions for you and to contact you regarding these positions, and also to send you interesting information and career opportunities.

Your data is only ever used within VIVATIS Holding AG, Maresi Austria GmbH and GMS Gourmet GmbH. Your data will not be used for automated decision-making (profiling). You can find information on the legal basis for the processing of your data under Section 2.

Your data will be erased when you leave our talent pools. By leaving our talent pools, you withdraw your consent to the processing of your data. In order to amend/erase your data, please use your myVeeta login or, for queries regarding data protection law, please contact Talent Solutions GmbH (https://www.myveeta.com/) directly.

7. Contact form

If you get in touch with us using one of the contact options provided on our website, your details will be stored so that we can refer to them for handling and responding to your enquiry. We will not forward this data to third parties without your consent.

Please inform us if personal data which we process concerning you is incorrect. We will rectify this immediately. We will of course erase your data immediately unless compelling legal grounds, such as statutory retention periods, prohibit us from doing so. 9. Cookie policy

This website uses Google Analytics, a web analysis service from Google Inc. (“Google”). Google Analytics uses small text files known as “cookies”, which are stored on your computer and allow us to analyse your use of our website. The information generated by the cookie regarding your use of this website is generally transmitted to a Google server in the USA, where it is stored. However, if you activate IP anonymisation on this website, your IP address will be abbreviated by Google within EU member states or other contracting parties to the Treaty on the European Economic Area before being transmitted.
